Any Dispute that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, which are available at www.adr.org. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

The arbitrator shall have the authority to award any remedy that would otherwise be available in a court of law, but shall not have authority to award punitive damages except as expressly authorized by applicable statute. The parties shall each bear their own costs of arbitration, except as otherwise required by applicable law or the AAA rules.

11.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. Unless both you and Jet's Pizza agree in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class or representative proceeding.

11.4 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court for Disputes that qualify under applicable law, provided that the action remains in small claims court and proceeds only on an individual basis.

11.5 Opt-Out Right

You have the right to opt out of the binding arbitration and class action waiver provisions by sending written notice to us at [email protected] within thirty (30) days of the date you first agree to these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
